1. Professional Scope
Our architectural services provide design excellence and technical expertise within our defined scope of work. We don't provide engineering, quantity surveying, environmental, or geotechnical services unless explicitly stated in your project agreement. Where specialist consultants are required, we coordinate their input but aren't liable for their professional recommendations or deliverables.
2. Site Conditions & Construction
We base designs on information provided to us and reasonable site assessments. Unforeseen site conditions—soil issues, hidden structural problems, or environmental factors discovered during construction—fall outside our liability. Contractor execution, workmanship quality, and material selection during construction remain the contractor's responsibility, not ours.
3. Regulatory Compliance
While we design to current building regulations and submit for approvals, final compliance verification and obtaining necessary permits remain your responsibility as the client. Municipal requirements can shift, and interpretation varies between jurisdictions. We guide the process, but we're not liable for regulatory delays or additional requirements imposed by authorities.
4. Third-Party Decisions
Project success involves multiple stakeholders—clients, contractors, engineers, municipalities, and suppliers. We provide professional architectural guidance, but decisions made by third parties that affect project outcomes, timelines, or costs aren't within our control or liability scope.
5. Limitation of Liability
Our professional liability is limited to the fees paid for your specific project and is covered by our professional indemnity insurance as required by SACAP. We're not liable for consequential damages, lost profits, or indirect costs arising from project delays, changes, or third-party actions. This protects both parties while maintaining realistic expectations for complex architectural projects.
